FIXING IDENTITY THEFT DEBT

        Identity Thieves run up debt in their victims’ names. When the thieves don’t pay, the creditor comes after you: the person whose name is on the account. The creditor will report the missed payments on your credit report and then send you a collection letter or sue you to collect. Sometimes, the first time you learn your identity has been stolen is when you are served with a debt collection lawsuit for a debt you know nothing about. Or, you may check your credit report, find a debt that's not yours, and then a letter or lawsuit follows.

        Getting sued or harassed for a debt that is not yours is extremely stressful. 

        The good news is that in California, you have rights against collectors of identity theft debt, and there are steps we can take to protect you.

        If a Claimant - that is, an alleged creditor or debt collector - is attempting to collect a debt that arose from the theft of your identity, we will defend you. We will also file a complaint against the Claimant seeking a court judgment that you are the victim of identity theft, an order to delete reports of identity theft debt from your credit report, plus damages for your troubles, attorneys' fees, and costs.

        If you have received a debt collection letter or are being sued for a debt which arose due to the theft of your identity, the California Identity Theft Act, Cal Civil Code § 1798.93, (CITA) gives you the right to file an action against the debt collector, seeking a judgment that you are the victim of identity theft and do not owe the debt. You are also entitled to actual damages, plus attorneys’ fees and costs. Under certain circumstances, you can also claim punitive damages of $30,000, but as a practical matter, this more typically provides negotiation leverage in settlement discussions.

       Our complaints for Identity Theft also include claims for violation of the Fair Debt Collection Practices Act and, if your credit score has been damaged, for violation of the Fair Credit Reporting Act
