  Having said that, your rights have likely been violated, if your employer has acted in any of the following ways:

 

1. Wrongful Termination.  California employment is “at-will”. If you do not have an employment contract for a specific period of time - and most employees don't - you can be fired for any reason or for no reason at all. (You can’t sue your employer for failing to recognize your awesomeness, or for not liking you, or for generally being an idiot. That's perfectly legal.HOWEVER, your employer cannot terminate you because of your race, color, national origin, gender, sexual orientation, sexual identity, age, disability or medical condition. A hostile work environment is created when a superior or co-worker engages in action, communication or behavior which makes it impossible to perform your job. The behavior must alter the terms, conditions or reasonable expections for a comfortable environment at work. The behavior must also involve discrimination against a member of a protected class (See wrongful termination, above).
