  Having said that, your rights have likely been violated, if your employer has acted in any of the following ways:

 

1. Wrongful Termination.  California employment is “at-will”. If you do not have an employment contract for a specific period of time - and most employees don't - you can be fired for any reason or for no reason at all. (You can’t sue your employer for failing to recognize your awesomeness, or for not liking you, or for generally being an idiot. That's perfectly legal.HOWEVER, your employer cannot terminate you because of your race, color, national origin, gender, sexual orientation, sexual identity, age, disability or medical condition. 2. Retaliation . You can also sue if you were fired in RETALIATION  for engaging in a legally protected activity, such as reporting or filing a  complaint for illegal discrimination against your employer, assisting someone else in filing a complaint, participating in an investigation, or for being a "whistleblower” by reporting an unsafe condition to a public entity or to a superior at work.

 

3. Discrimination/ Hostile Work Environment. A hostile work environment is created when a superior or co-worker engages in action, communication or behavior which makes it impossible to perform your job. The behavior must alter the terms, conditions or reasonable expections for a comfortable environment at work. The behavior must also involve discrimination against a member of a protected class (See wrongful termination, above).

 

Not every instance of insensitive, offensive behavior causes a hostile work environment. Courts will consider the frequency, nature and degree of harassment in reaching a decision.  If you have been bullied, harassed or otherwise subjected to a hostile work environment, call us. 

 

4. Unpaid Wages. If you are not being paid for working overtime; or, if you are not being paid for all the hours you’ve worked, your employer is stealing from you. It’s called: Wage Theft ! Don’t allow it. You have rights.  We can put the California wage and hour laws to work for you.

 

Unpaid overtime can occur because the employee is wrongfully classified as a supervisor, when, in truth, less than 50% of the time involves supervisory duties; or, as an independent contractor, when there is nothing independent about you.  There are other common overtime and regular wage violations as well.
